Hi all i have an apple iphone 4 16gb on three,i purchased this phone recently from ebay under the impression it was working but it will no power on.will apple swap it for a new one if i pay 119?
does it matter that someone has opened it and tried to fix it previously to me getting it and does it matter that its bee water damaged?

Apple will not touch or replace an iPhone that has been opened.
Pursue a claim through eBay if the iPhone was advertised as
working.
but what is the deal with paying the119 and getting a replacement if the phones out of warranty?
As long as it is intact (no parts missing, no parts physically separated from the whole) it should be eligable for an out of warranty replacement. Apple will make the final judgement, regardless of anything mentioned here, so just take it in and ask them.
Michael Black is correct that you should take the iPhone to Apple
as they are the final arbiter as to whether an out of warranty iPhone
will be issued.
Be advised that several posts list the out of warranty cost for an iPhone
4 as being $149US and not $119 as you state.
You should also pursue a claim with eBay if the iPhone was advertised
as working.
