My right EarPod sporadically doesn't work when the cable is touched by something.

I bought EarPods recently and I can't hear the right EarPod when the cable is touched by something. The problem is that my EarPods have some little 4-5 scratches on them too bad I use things too rough. I wonder the scratches voids the warranty.
