Screen on my IPAD has been cracked just by finger touch. Apple US has sent me to local Apple care (Russia). Local guys asking me for foto of the screen. And after that sad that it's not waranty. I belive that it should be a mistake and screen could not be cracked from finger touch (usual work).

Apple will exchange your iPod for a refurbished one for this price. They do not fix yours.

Replace the screen yourself
I think that apple have to change my device in case that it's manufacture defect. But they do not agree with this (more suprised that they have not seen device at all).
Make an appointment at the Genius Bar of an Apple store and press the issue. Go to the store manager if necessary.
