How do you know its a refurbished one? Apple don't do this normally.

Actually, that is indeed the normal thing. iOS devices (iPhone, iPod Touch, iPad) replaced under warranty are routinely replaced with OEM factory refurbished units. Only rarely will a warranty replacement be a brand new unit, such as when refurbished inventory is unavailable.

The only time you are likley to get a new unit is if you are returning your new iPhone within the 30day unconditional return period, when technically what you are doing is returning for refund and then buying a new one (but they actually will just swap it at the store to accomplish that).

Once your unit is past the unconditional return period, it is no longer "new", so almost no company will give you a new one in exchange- everybody uses refurb's for warranty exchanges on mobile devices.
