Has your iphone ever been unlocked via a jailbreak? if so this will be your issue

The OP has not explicitly stated the iPhone was hacked/jailbroken...

The causes of this problem most frequently are one of the following:

1. Security software on the computer used to update the phone or the router providing the WiFi connection for over the air updates is blocking access to gs.apple.com
2. The phone has been jailbroken or hacked to unlock it
3. The phone has not been jailbroken, but the computer used to update it has been used to jailbreak some other device.

For the last 2 you will have to go elsewhere for help. Although for 3. removing lines containing gs.apple.com may fix it.

I'm sure that it is probably JB, but then again, I don't want to jump the gun...
