Dark spot on iPhone 5 photos

iPhone 5 that I bought in France in December 2012 got that weird kind of stain on its sensor yesterday. It was in my pocket for some time, then I got it out, made a few photos, put it back. Next time I take it out of my pocket and launch Camera app I notice a dark spot in top half of picture, as in here:

You can see it all the time, not only after taking a photo or video, so it's physical.


I am interested in whether the case is unique or not and how serious this is. I was told it can't be a particle of dust since it's almost impossible for it to get in there. But I hope it's not sensor's fault because this kind of thing would be expensive to fix. Since it was bought in France, and I live in Russia, I cannot use warranty repair in here, thanks to Apple's warranty policy.
