Q: Can't start (or create?) iCloud account, what am I doing wrong?

I want to take full advantage of all the functions in my iPod touch. But when I try to start up iCloud I keep getting the error message that 'due to server problems' I cannot do it. That has been happening for as long as I have the iPod. There is no iCloud app as far as I can see. Do I have to download that first? I am at a loss here. Thanks in advance for any help.
