If your computer shipped with Mac OS X 10.6.8 or earlier, it's on the computer's original disks. If it shipped with Mac OS X 10.7 or newer, you can get it for free from the Mac App Store.

If you don't  have the original set of install discs you'll need to buy iLife from the App Store or somewhere like Amazon or EBay.

    Thanks for your help Niel,

I think it is  OS X 10.8.2, but when I go to Mac App, they ask me to pay for it. any idea about that?

It depends on what OS it originally shipped with, not what OS it's currently running. For a late 2009 MacBook, this will be 10.6 or 10.6.1, which means you'll need the install DVD.
