You have to options:

1) Let it go, even though you're right!

2) If you decide and insist to perform this right, legal quality assistance will be necessary. I doubt you can handle this alone.

Thats how these things work, you maybe right in this case but you still have to proof it.

All AppleLoops are royality free, but they're are copyrighted! This means, you're not allowed to use a single loop and declare that as your own work. You have to combine them with other loops or own playing/recording. The reason for this is, that you may not re-distribute the loops. Taking one loop and put this on sale is some kind of re-distribution. I think, there's a EULA for the supplied content, that explains the same using several pages.

Anyway, a re-distribution doesn't seem to be the case with the recording from Kontor Media and your recording. But the flute solo is very prominent in both cases and that's why it's got catched automatically by the youtube upload QA. They have some shazam-type testing, which seems to work even on detuned material.

Actually, you need to resolve the dispute with youtube or Kontor Media. You need to explain, that you used a loop from a factory content, but transposed to another key to make it fit.

I have had a problem where my music was taken down after a company manually flagged it for using the same picture while playing as their own did. (It was a logo of a company that did distribution fo the both of us and surprisingly the label guy was never told and though it was his artists)

First port of call is a direct email to Kontor Media, explain the situation and ask that they fix it as the actions are being taken on thier behalf. Kontor get given tools that mean unbanning your video is a one click affair. Second port of call is Apple support, as Kontor is claiming ownership of thier copyrights. Inform Kontor when you do this. Only THEN go to Youtube with evidence of both and attach a clean copy of the sample (in your key not thiers) from garageband as proof that it's a free loop.

Not much else I can suggest, my issue was nipped in the bud early on.
