Will apple give me a new phone, without apple care for it keep saying I don't have no service when my phone bill is paid and is on.

Remove sim > insert again.
If this did not work.
Restore iPhone via iTunes and set up as new iPhone.
If this also not worked, contact apple support.
The phone has a 1 year warranty. If it is defective, or has failed within the warranty period, and it was not physically damaged, hacked, or jailbroken, Apple will replace it under warranty.
If it is outside of the 1 year warranty, then you can get an out of warranty replacement from Apple for US$149 (for an iPhone 4).
Where things stand between you and your cellular carrier is not a concern to Apple.
