Top button not working

I am guessing that is the power button. What does it not do?

It does not lock when I touch the top button every time
If the button is not working -- is not locking when you click it, then note your iPhone is eligible for warranty support, and you should contact Apple Support and let them invsstigate.
Here's how:
Do you mean it doesn't put it in sleep mode so that you have to enter your passcode to unlock it to get back into it? In Settings - General - Passcode Lock, do you have it set to "Require Passcode" Immediately?
