i tried 4 times and every time it says i have to download some music and i cant cuz i gtg to bed

I do not understand what you are saying. I do not understand why undisabling your iPod by:
Place the iOS device in Recovery Mode and then connect to your computer and restore via iTunes. The iPod will be erased.
iOS: Wrong passcode results in red disabled screen
If recovery mode does not work try DFU mode.

Has to do with downloading music.
