Place the iOS device in Recovery Mode and then connect to your computer and restore via iTunes. The iPod will be erased.
If recovery mode does not work try DFU mode.

thanx for replying neither recovery or DFU worked... I got my husband to sort it in the end, he had connect to itunes then completly download upgrades and all sorts to reboot, not sure what he actally did but it took nearly 2hrs.... done now.. My son has had to re-load everything and his photos are lost cause he didnt back anything up...
