I dont have a mac book store, and I can't update/upgrade my software.

For some reason I am unable to purchase mountain lion, because I dont have mac app store

Hello,

Minimum requirement to purchase and upgrade to OS X Mountain Lion is to have at least the latest version of Snow Leopard (10.6.8). Also check other requirements : http://www.apple.com/osx/how-to-upgrade.

Are you running 10.6.6 or later? That's a requirement to get the Mac App Store. Otherwise you'll first need to buy Snow Leopard, then upgrade everything to the latest version, and then run the Mac App Store.
