hi all ive just bought a secondhand iphone 4 from a friend who has upgraded to a iphone 5 the problem im having is that its locked to 3uk and i want to use it on my provider o2 how do i go about unlocking it?

Only the Original Carrier the Device is Locked to can unlock it.
Ask 3uk to unlock it.

even without my friend being there and having no 3 sim??? it is a legitimate phone i do have the box and all the relevant paperwork to go with it?? can apple ot do this themselves?
No, you have to do it through 3 and your friend may have to do it for you.
