Passcode Protection

I know you can set the iTouch to delete all data if the passcode is selected incorrectly several times.

Unfourtunatley mine was not set that way and its now missing.

How secure is the data without having

the pascode?

I know that the iTouch gets disabled after so many tries but lets you try again later. Those times get

longer and longer with time, but is the data still locked safely, what about if you put it in restore mode

to bypass the passcode, does that erase the data?

I read the following and passcode protection from apple.
