Are the Earpods under warranty?

I purchased the Apple EarPods a while ago separately from an iPhone and they are having problems can I have them exchanged? I was told at RadioShack, the place of purchase that they were covered under the Apple Care Warranty.

EarPods-OTHER, iOS 6.1.2

All Apple manufactured accessories carry a 12 month Apple warranty

go to an Apple retail Store Genius bar

Apple care is an additional Apple warranty extension that has to be purchased

separately

not just an apple thing it's the warrenty laws everything in the box == same warrenty
