I have seen more people reporting/posting this issue on the web but always without a reply or solution...
Mac mini (Mid 2011), Mac OS X (10.3.x), with Bootcamp/Windows 8
So, in the previous scenario I had installed Win8 BEFORE I obtained the magic mouse. Removing and reinstalling Win8 (now with the magic mouse) fixed the issue

Celebrated too soon.
After the new install of Win8 the mouse and keyboard were working fine. At that point I had not yet installed the Bootcamp drivers (and the generic Windows were active). The only thing that didn't work was the 'scrolling' feature of the Magic Mouse. Once I installed the Bootcamp drivers (v5.0.5033), although the 'scrolling feature now works, the freezing on&off started again...
I have no idea how to fix this
