when i try to restore my ipod a message comes up saying "This ipod software update server could not be contacted" what do i do now?!

The mesage says make sure that your network settings are correct and your network connection is active..I tried restoring and that is what it does. I cant contact Apple because my ipod is out of date according to my serial number and now im out of luck...helpppp meee 😢
