i have bought a iphone 4 and its got a password on and the guy who i bought if off has forgot it how do i reset the phone on itunes

You need to use a computer with iTunes, then follow the steps in: http://support.apple.com/kb/HT1212 and you may need to go through those steps more than once.

I wonder if this story will held in court.......

I'm sure a few people might actually forget a passcode; it can happen.

I know, wj...just my point, not trying to assess the status of the 'purchase' but just answer the question.

We see so many forgotten passcode questions it is not hard to believe a seller could forget and then put the buyer in a bad position. However, a buyer should in reality walk away from such a purchase, at least in my opinion, which with $2.39 will get you a Starbucks downstairs 😝
