Stolen iPhone - My 4s was stolen, it was switched off immediately. I have since got a new phone and after 2 weeks all my photos in the old phones photo stream have now appeared on my iPhone 5 photo stream. Does this mean that my old phone is on?

My iPhone 4S was stolen 2 weeks ago. I since purchased a iPhone 5.

Today I now have the photos from my old phones photo stream appear on my new phones photo stream.

Does this mean my old phone is being used or turned on?

The old phone was disabled by my carrier.
