Update your iPhone 5 to iOS 6.1.3 and set it up as a new iPhone. Then go to Settings>General>Reset, tap Erase All Content and Settings, go back through the setup screens on the phone and when given the option, choose Restore from iCloud Backup. You will then be able to restore your iPhone 4 backup to your new phone.
