Problem setting u an iPhone 5 with iCloud backup

Can anyone assist. I have bought an iPhone 5 and don't have my lapto wi me. I have backed up my iPhone 4 using ICloud but when I try to set up the iPhone 5 with restore from iCloud backup it says the backup was done n a new IOS version than the iPhone 5. Without my laptop I can't use iTunes to update the new iPhone IOS and yet I also can't get passed set up unless I set it up as a new phone????????

any ideas. Is it possible fr the apple store to update the new iPhone 5 IOS first for me???

you can update your phone on the phone itself. go to settings > software update and download and install the update. then you will go to settings > general > reset > erase all content and settings, and you can restore from your backup in icloud at that point because your phone will be up to date

Thanks for the speedy response. Unfortunately because the Iphone5 is brand new I can't get in to settings to do what you suggest. I am given 3 options. Set up as a new user, set up from iCloud back up or se up from iTunes. When I say set up from iCloud it shows me my backed up stuff but says its not compatible.

I decided to set it up as a new user and update the IOS as you suggest but now I have the most uptodate version compatible with the back up but it thinks I am a new user and if I go t iCloud it will just create a new back up from the new phone. It doesn't know I already have one?
