Ipod touch screen randomly quitting.

I just bought a new iPod Touch 5th Generation less than 2 weeks ago. About a week ago a problem arose. Now, sometimes the screen will randomly stop working and do things that I don't want it to do(e.g. open apps). It will also do things when I am not pressing the screen. Can I take it back to the store where I bought it from and get a new one free of charge?

I would first try:

- Reset the iOS device. Nothing will be lost

Reset iOS device: Hold down the On/Off button and the Home button at the same time for at

least ten seconds, until the Apple logo appears.

- Unsync all music and resync

- Reset all settings

Go to Settings > General > Reset and tap Reset All Settings.

All your preferences and settings are reset. Information (such as contacts and calendars) and media (such as songs and videos) aren’t affected.

- Restore from backup. See:

- Restore to factory settings/new iOS device.

If still problem, make an appointment at the Genius Bar of an Apple store since it appears you have a hardware problem. If your iPod is defective and not abused Apple will exchange it at no cost.

I have already tried resetting the iPod and I don't want to restore the iPod. The closest Apple store to where I live is about an hour's drive, so it would be a bit of a hassle to drive an hour for an appointment that lasts about 15 minutes and may not solve the problem. Also, the lock screen will have thin red and blue vertical lines or thick white lines, so that is an indicator if the iPod is glitching or not. the iPod will sometimes work for long periods of time without quitting, other times it can only last a few minutes. It seems to have gotten worse in the last couple of days. It freezes quite often, at least once a day. There are only 2 days left before 2 weeks are up, so it would be bad if I am stuck with an iPod that keeps glitching.
