After updating my iphone 3gs to a new iOS it comes up with an activation error - this phone has NOT been jailbroken and I have tried apples suggestions. Is there anything else I can do - or should I go just in to an apple store?

What is the exact error message provided and please list Apple suggestions you have tried or include the link with the suggestions.

And the error message says: Activation request could not be completed. If the problem persists, please contact customer care.
After doing a factory restore this message comes up in itunes:
We're sorry, we are unable to continue with your activation at this time.
I am also trying to activate it without a SIM... I lost my 4S last night and am trying to use this one with the internet for the time being until it is either returned or I get another SIM. The phone was working perfectly until I did the ios update

There lies your problem - an iPhone cannot be activated without a SIM card inserted, and activation is required when restoring an iPhone with iTunes and when installing an iOS update.
So I will not be able to use my phone until I purchase a SIM? Can I insert someone elses sim and activate it and then remove it?

Insert the SIM card from your new, activated iPhone or one that was previously used to activate the original iPhone.
What happened to the SIM card that was used with this iPhone when it was activated?
The Sim that was used to origionaly activate can no longer be used as the number was ported over to a new sim for the 4S. Okay, looks like I may have to go buy a new Sim - thanks.
