About 40% of my songs have not/can't be downloaded onto my new iPhone from iCloud. (I have an older Windows laptop)
They are greyed out and I can't even play them? Please help!

Are you signed into the Apple ID used to purchase these grayed out songs in Settings>iTunes & App Stores?
Yes, iCloud downloaded some of the music but not the others. and they were all downloaded the exact same way, so i dont understand why it worked for some and not the others! hah confusing
I'm not sure why that happened, but you might want to just download them to your iTunes library and sync them to your phone instead.

I had the same problem. I deleted the grayed out song from my iPhone and synced with the song on my
Itunes library. No longer grayed. (Pain to delete and then resync. Had a lot of songs)\
