Do a reset..it solves most of these kind of issues..
In ur home screen , double tap the homebutton and delete all the apps in multi tasking and then hold ur power button and homebutton simultaneously for about ten seconds or so until you see an apple logo. do not worry ..you will not loose any data...
After you have done it..try and operate the "do not disturb button".
If it is still not working then it might propably be because of some software glitch.....i recomend that you update ur mobile to the latest firmware 6.1.3..since it solves many small issues like these..

May 24, 2013 5:27 AM in response to sandeep.vietlaby steve097,I now have 6.1.3 and also did the reset but no joy. Getting around the problem by using 'scheduled' and setting it from 6.00 to 6.01 am. Not happy that the problem is still there.

go to the settings and then general - reset - reset all settings....
it should do it....
if u still see that the do not disturb option is on then it is better that you restore ur device once by connecting it with itunes...
