The brightness will change whilst im using it and also when i lock it and put it away and then when i use it again the screen will be nearly black!
Can anyone help!

I'm having the same issue. iPhone 5 currently, have been an iPhone user since day 1. Auto-brightness is turned off. When I go into settings to check/fix the brightness, the slider is in the middle- where I want it to be- and all I have to do is touch the slider to return the screen to the correct lighting (no adjusting of the brightness slider).
Going to the Apple Store tomorrow to see if this can be addressed.
What version of iOS, I believe this was specifically addressed in 6.1.3.
I'm running 6.1.4. I've had the issue sporadically since I got the phone (on its release day), but often in the past week.
Is there a screen protector or case on the device? If so, remove them and see if the problem continues.
Also, have you tried a restore as new?
