I bought a brand new upgrade off ebay about 4-5 months ago, its locked on EE (orange/T-Mobile), I want to sell the phone but no one would buy it due to being locked. Since its second hand i wont get to unlock it or am i able to?

Only the carrier can unlock it, and usually they will only do so for the original owner.

No. Only EE can unlock the phone for you or your other option is to keep the phone and use it with EE, the network to which the phone is locked.
Why did you buy the phone in the first place, if you can't use it if you can't get it unlocked and you can't sell it either?
Im contracted to EE but i want to change phones and sell the iphone but due to it being locked, not alot of intrest in the phone.
Well, if you have a contract yourself with EE, then all you need to do is contact them and they should authorise the unlocking of the phone for you. All the UK phone companies from T-Mobile, Vodafone, 02, Orange and EE offer unlocking, so contact them and ask them to unlock it for you and then you will be able to sell an unlocked phone.

If you have a contract with them already, then contact them and see if they will unlock the iPhone for you. As it is a second hand phone they may need the previous owners details before they will unlock, but you might be in luck if you already have a contact with EE yourself.
Contact them and see otherwise, if they refuse to unlock the phone for you, there is absolutely nothing that you can do. You can either sell it again stating that the phone is locked to EE and see if anyone will buy it, or you are stuck with a phone that you can't use unless you take out another EE contract to be able to use it.
I don't quite understand why you bought the phone in the first place if the phone was locked to EE and previous owner did not get it unlocked before selling. Perhaps you should take out a claim with Ebay.
If you have bought the locked Iphone on Ebay, that's a big mistake you have made, that phone must have been stollen. That's what alot of the Iphone thiefs are doing now, after stealing the phone and are unable to unlock it, then they will sell it on Ebay to innocent buyers. My Iphone 4s was just stollen.
