I have had this iPod touch 5g for 3 months now and I always play loud music on the external speaker but now I have started to notice a faint static noise coming from the speaker . What could it be and how do I fix it? I have a warranty also for 3 years can I get a new one ?

Try to reset the device by holding the sleep and home button for about 10sec, until the Apple logo comes back. You will not lose data by resetting.
If this does not work, get it serviced, might be a hardware problem.
The noise still happens after I restart it it is probably a hardware problem it only happens when I play music to the highest volume should I get it fixed now or if it gets worse ?
I would make an appointment at the Genius Bar of an Apple store. The appointment is free.
As already mentioned, get it looked at by visiting an Apple Store next to your place or contact Apple to get it serviced, before it gets worse.
