What iOS is on the iPod? you need at least iOS 2 to get the App store and use apps. If yo do not have at iOS 2 then you have a 1G. Those can go as high as 3.1.3 that you get htere:

Jun 20, 2013 1:03 PM in response to mamma_joyby Sanmannyer,You may want to check the serial number on back of the ipod and search it on google. If there was app store before the reset was done, then u may have to update to the latest vesrion avialbale for ur ipod

And for 3rd gen is : A1318

It's an older Ipod given to my 9yr old son to play his games he has on my iphone so he doesn't have to be on my phone all the time. I really don't want to pay $200 for a new one since he so young. I just wish I could get the app store back

Jun 20, 2013 1:20 PM in response to Sanmannyerby lllaass,Sanmannyer. he says he has an old 1G or 2G iPod the Settings>General>Software update is only available for a 3G and later and if it has iOS 5 or later.
