How do I get into my phone without having to restore it and losing all my data. I have not backed up my phone and it won't let me now since it locked. I don't have icloud in sync with my phone.

Restore is the only way.

Forgotten Restrictions Passcode Help
You will need to restore your device as New to remove a Restrictions passcode. Go through the normal process to restore your device, but when you see the options to restore as New or from a backup, be sure to choose New.

You cannot.
Once the Device is asking to be Restored with iTunes... it is too late to save anything..
After you have Recovered your Device...
Re-Sync your Content or Restore from the most recent Backup...
Restore from Backup
