I have purchased a used 2nd generation ipod touch for my daughter to use. We are trying to put some games on it but says we do not have the right software. How do I get new iOS software on the ipod?

Connect the device to a computer and use iTunes to update the OS.

I have synced it several times and it says that I am updated. I have 4.2.1 but need 4.3.1 to have games work on the ipod.

That iPod touch can't be updated past 4.2.1. Sell it and buy a third generation or newer model, or an iPhone 3GS or newer.
