Multiple questions : iPod Touch 5th

Hello, here my questions :

iPod Touch 5th generation 32 go:

1. My homme button doesn't works. I want to know if Apple will repear the iPod or just give me a new one ?

2. Also, how many time it can takes ?

3. Does the OS install on my device can cancell the reperation or cause trouble in the Apple Store ? I have iOS 7 install (i'm not a developper)
