Is a non educational multi-touch book still classified as a textbook during submission?

This is what I received from Apple:

Non-functioning EPUBs

All EPUBs must open and function as expected in iBooks on iPad, iPod Touch and iPhone iOS devices. Books must not perform poorly or crash the iBooks application.

I've tested the multi-touch book on an iPad1, iPad 2, and iPad Retina with no issues. This makes me think that there was a submission error. Any insight would be appreciated.
