So, you think they would do that? Even if theres no damage or anything wrong with the phone? And does the phone have to be in service like with a valid phone number at the time?

Heck no! What earthly reason would a business (much less the service division) send a repair out the door with an entirely different and improved model?

Uh, dude.. I think you need to do some reading on these forums.. It's been posted many times before that currently, they are replacing 3GS with Iphone 4 since 3gs has been discontinued for quite a while now.

If Apple is taking responsibility for a defective iPhone, that's one matter in and of itself. That's not the scenario in the question as written.
You asked and i answered. If you think you know better, why ask?
Warranty replacement is and always has been for the same model, color, and capacity.
That being said, individual stores have the ability to replace with a newer model, higher capacity, or different color if they are out of a specific model.
The expectation should always be that you will get the exact same make, model, and color. Also, Apple will only replace a device if there is an issue with the device, the Out of Warranty replacement program is not and upgrade program.
