Upgraded my iPhone4 to an iPhone5 yesterday. Backed up my iPhone4. Opened iCloud on my iPhone5 and Apps are there but PICTURES and NOTES did not transfer. The store still has my iPhone4 and will not wipe it clean until I figure this out however, I need to do this ASAP. Can anyone help me?

were the pictures in your camera roll? ie photos taken from your phone.
Did you do a restore from your iPhone 4 backup?
Yes - pictures were on and taken with my iPhone4.
Regarding RESTORING FROM BACKUP - they did the set-up of my new phone in the store while I waited. So I'm not entirely sure I'd they restored from my backup from the iPhone4. They had me take it home to complete "the backup" as they said their wifi connection was saturated with use from everyone in the store and it would tack forever. So I did that. Was I backing up what was restored? Also - all of my Apps were there on iCloud so does that mean there was a restoration?

Yes on yoru new phone go to settings - general - reset - erase all contents and settings - once it is done restoring, then you will have the option to restore from backup choose that.

Yes. That is how I backed up the old phone. And, after the sales rep set up my new phone I took it home and backed that one up per her suggestion. I was not watching to see if she did a 'restore' when she was setting up - .
See if you can get the old phone back from the store. If so then do a backup of your old device in iTunes, its a better backup than iCloud.
Ok. New problem. I went to settings - general - reset - erase all contents and settings - I erased all contents and settings. Prompted me to start over -- and I can't get past ACTIVATION. "Activation failed. Please retry activation.". Been doing that for about 30 mins now.
What do I do now?
Never mind - got in. Restoring from back up now.... Be back with next bump in the road, I'm sure.

Thanks for your help ~ when I got in I realized that she did not choose my OLD phone to restore from. All good now - pictures, notes, contacts -- everything!

Great. Something else that you should be doing as a backup for your pics and videos. YOu should import your pics and videos to your computer http://support.apple.com/kb/HT4083 as a secondary backup copy.
IF you delete those pictures, you can always sync them back to your phone via itunes.
