Q: Update Software Tab is not showing on the ipod

Im trying to update my daughters ipod touch to download an app.  When i go into setting, general, it is not showing the update software tab.  I tried plugging the ipod into the computer and go through itunes but it tells me that the IPOD software update server could not be contacted.    Make sure your network settings are correct and your network connection is active, or try again later. I've also tried restoring the ipod but continue to have the same problem.
