Q: I am not able to open the settings icon from my old iPAD. When I try to select the settings icon it looks like it's about to launch and open however; it will not stay open. I am trying to transfer all my data from my old iPAD to my new 4th gen iPAD

Try a soft reset - press the home and power bottons and keep them pressed until the Apple logo comes on. Then see if you can access Settings.
