i cant get any games on my ipod. all the games i click on say ios 4.3 or ios 5.0 or whatever even games that are my ios.

Update it from iTunes on a computer as described at the bottom of this article; devices running an iOS version prior to 5.0 can't be updated straight from the device. It will be updated to the newest iOS release supported by the device’s hardware.
The original iPhone and first generation iPod touch can’t be updated past 3.1.3.
The iPhone 3G and second generation iPod touch can’t be updated past 4.2.1.
The third generation iPod touch and original iPad can’t be updated past 5.1.1.

As stated above, update it from iTunes on a computer and not from the device itself. An iPod touch isn't a computer.

i click download itunes on the computer. and it doesnt work it says you can not download itunes on this computer. so it doesnt work i guess

The appointment is free, There should be no cost except if you have a 1G iPod with iOS 2.1. In that case to update to the last update for the 1G you have to pay.
