Warranty problem...Absurd???

Hi everyone, I've had a wierd situation and would like some advice...


When I bought a brand new ipod touch (4th gen), I had defect earpods, so I went to my apple reseller to replace them, ok he does it, BUT informs me that I no longer have the one year warranty for them but a 3 month warranty instead!!!


Is it normal, legal????

If Apple provides service under warranty, the terms of the warranty and applicable provisions of law will cover defects in materials and workmanship that arise during the remaining warranty or 90 days after iPod service, whichever provides longer coverage for you. If iPod service is provided outside of warranty, Apple warrants that the replacement iPod will be free from defects in materials and workmanship for 90 days from the replacement ship date.
