Sprint iphone 5 losing 3G connection randomly help.!?!?

Hello I just got my iPhone 5 yesterday and I noticed 2 issues with it

1. Seems like my iPhone came with some scratches but very small any help on that?

2. My phone seems to loose 3G connection randomly and turns to a little circle but I have full bars of sprint any help??

But when it loses 3G connection it's pretty quick like a couple seconds and then changes back to 3G
