It's nothing to do with your 'rights'. It's not technically possible to locate a phone using only the IMEI number, or the serial number. In order for a lost iPhone to be located you have to have set 'Find My iPhone' up on it before losing it, and it has to be on, not wiped, and able to connect to a network (how else could it transmit its location) - if any of these conditions is not true then locating it is not possible.
I'm sorry, it's all a beauty what you guys wrote, but still doesn't make any sense. Either you didn't get what I was saying or you just don't want to think for yourself.
Basically you're saying it is totally OK to have a tracking device on your iPhone, save Serial Number and IMEI on your iCloud account (yes KiltedTim, the IMEI is saved on the iCloud account under your Devices, you can check it) as long as you have it with you or it's turned on, connected to the internet, with YOUR data.
From the moment someone picks it up, turn it off and restore it (IMEI and Serial Number will NOT change) it's no longer your device, Apple no longer cares ? It's too much of a hassle for Apple to connect the dots and figure out that if I reported that device as stolen on my account it's probably because.. its was stoled and should not be used ? And if it is being used, I should be warned somehow ? People can send proof of purchase.
I'm not saying real-time tracking all the time, but if Apple indeed link the device to us like they make us believe, maybe people will be a little discouraged to steal these type of devices. With the technology available today is just ridiculous that this doesn't happen, no matter how you put it.
If someone steals your car, you report it, and they try to put it into the legal market again, a simple char validation on the license plate will say "look, this license plate is set as stolen, this car cannot be used" - this validation can be done by a 15yo programmer..
As long as it is linked to your iCloud account, activation lock will prevent anyone from using it. You can also blacklist it with your carrier (in the USA, all carriers use a federally mandated universal blacklist, which is honored by most or all Canadian and Mexican carriers as well).
The car analogy doesn't apply. Automobiles are a regulated consumer product requiring registration of all sales with a central government authority right from the moment a manufacturer sells it to a dealership, wholesaler or importer. Cell phones are not regulated and there is no government (nor legally required) registry of cell phone sales.
And just to play devil's advocate, why should any company "care" what happens to your personal property once you own it? There's no logical reason why any third party should care about your stuff, or go to the effort and expense of tracking it or monitoring it's ownership status or anything else about it.
"Registration" is the simple act of assigning something to someone, using a unique parameter as an identifier. This IS done by Apple, it doesn't necessarily needs to be done on the act of a sale.
There is no point in complicating it.. to do this it doesn't require nothing else than what's already being used by Apple or the device itself, it's just a matter of wanting or not wanting to do it. And clearly they prefer to have stolen devices to be passed around, so that people continue to buy new ones.. sad.
Regarding the care or no care from this or any other company.. thinking like that explains a lot why the world is like it is.

There are perfectly valid legal and privacy issue reasons why NO company does what you want Apple to do. And I hope no company ever does. There is far more than enough "big brother" behavior amongst business already. We don't need companies playing cop and overseer as well, and I for one sure don't want them to.
I'll accept responsibility for my own private property, and I really don't want any company stepping in to that aspect of personal life at all - it's not a door I'd like opened for companies to go through.
Apple is NOT a law enforcement agency. It's not up to Apple to track the device using anything other than Find My iPhone. In fact, it would not be legal for them to do so. The cellular carriers have the ability to do so when presented with the proper orders to do so from the courts. The comparison to a stolen car is not a valid comparison. Cars are registered with the DMV. It's a completely different situation.

What IS frustrating here, is when those of us have done our due diligence, activating the "find my phone" security feature on our devices...the unfortunate act of theft occurs, so as soon as we realize indeed it is not lost, but stolen, we rush to alternate resource and activate "lost phone"; as well as notifying last place in possession(if possible) and law enforcemen.
WE then are tortured as the alerts come in notifying us "YOUR PHONE HAS BEEN FOUND" (if any battery, device automatically connects to wi-fi as part of security features--to track/find)...which include specific details of location, all the towers it's pinged on their outings, seeing that little green dot identifying the curre location & movement of device.
ALLTHEWHILE, law enforcement, without a solid ID of offender(s), have no justifiable reason to search alerted location. Even w/all the GPS data ("device in the area, not precise"), police can only "ask for device" at suspected location/door--if it even escalates to them visiting alerted locatio/residence
[i.e. the "theft victim" attempts to recover phone on her own, byway of visiting GPS validated residence/location, then calls 911 from neighboring apartment for security reasons]
So after doing everything "right"...with full knowledge of her functioning device's location, she has ABSOLUTELY NO RECOURSE...
Thus, solemnly returning home empty-handed, she initiates process of filing the claim for a replacement device, (w/the insurance plan she diligently purchased through her service provider), as well as the bittersweet action changing settings in the "Find my phone" app from an alert msg.{"This phone has been lost/stolen. Please call xxx-xxx-xxxx"}, to the {"DELETE" option}...by which the next time device is "online", all content, settings, etc. on her device --including THOSE pictures (taken day of theft & yet to be backed up) of her child's first softball practice.
THIS, the lack of recourse, after heeding such caution, & the arduousness that ensues, (including a $199 deductible to replace the '3/4+ paid for', nearly new, spotless device), in my microscopic opinion, is the "IT" of any perplexion here. It is certainly what leaves the incensed pit in my stomach.
Ironically, you who are so disgruntled or confused, are missing the ONLY win in this scenario, that being APPLE's iron-clad security....if you used it.

EVERY message that says "YOUR PHONE HAS BEEN FOUND" is a SCAM to get you to reveal your password to the thief or to disable Find my iPhone. Apple does not send messages saying this.
If you have enabled Find my iPhone you will never get a legitimate message saying it has been found, or anything else about your lost/stolen phone.
If you had set up 'Find My iPhone' on it prior to losing it you can block it from http://www.icloud.com. If you didn't, you can approach your your Service Provider and ask whether they can block the phone (not all providers will do this) - this will permanently brick it.

There is no way to know who is using it. If you enabled Find my iPhone before you lost it you might be able to track it if it is powered on and connected to mobile data or WiFi. If you did not enable Find my iPhone there is no way to track it.
No one here can track your phone, and only the police can track it by imei.
