If you do not open the mail application then mail will not run, effectivly disabling it.

You will most likely need to remove mail from your login items. Go to System Preferences->Users & Groups select Login Items and remove Mail from the list of startup items.

So when I tried to do this and I look under login items my Mail is not even on th list of startup items, I only have on the list Itunes Helper, adobe resource sycronizer and real player downloader agent.  I just want to delete the mail for good on my macbook pro, its annoying and keeps crashing.

If you delete the Mail app, apps such as Safari and other native OS X  installed apps may not function or launch at all. Not a good idea pre installed Mac apps. Just don't use it.
