my iphone5 lock button is broken, would i be able to exchange for iphone5s?

Suddenly, I found out that the lock button on my iPhone5 is not working anymore.

I can only lock it when I press the left side but slightly pushing it to the front.

I'm wondering, now that iPhone5s is now out would I be able to exchange it?

iPhone 5, iOS 6.1.4

Warranty replacement has always been same model, color, and capacity.

under the apple care policy, it most likely states that you get the service and repair of your existing current iphone, unless it it faulty, you would get same identical iphone if it was faulty. if you have a perfectly good iphone 5, you can exchange it to your local apple store, and get some refund of it worth, and you can then invest some of that refund + some of your own to buy the next iphone model.

The warranty clearly states that replacement is same model, color, and capacity.

I has always worked this way, regardless of model. It still works this way for the 3G and 3GS. Unless and until Apple says differently, this is the way it will work for the 5.
