Try:
- Powering off and then back on your router.
- iTunes for Windows: iTunes cannot contact the iPhone, iPad, or iPod software update server
- Change the DNS to either Google's or Open DNS servers
Public DNS — Google Developers
- For one user uninstalling/reinstalling iTunes resolved the problem
- Try on another computer/network
- Wait if it is an Apple problem

I've already tried a few of your solutionsbut some I'm not to sure on how to go about doing some of your other tips..
What does open DNS IP addresses do?
the same question for public DNS-Google Developers, what is that and will that help my problem?
i will try and power off and restart my modem and will get back to you if that was the problem.
also how do i know if it's a apple problem and not a problem on my behalf?

DNS is domain name service. It is a database of name like app update server and their IPS address associated wth that domain name. The internet works by IP address. Sometimes the DNS that you use can have the IPS address of the update server incorrect.
Open DNS and Google have good DNS servers
also how do i know if it's a apple problem and not a problem on my behalf?

or do i have to go with them both? i Don't really know what to do when it comes to this kind of stuff
And is it safe to use?

Im not running "The Open DNS" that didn't seem to work either

No the ipod wasnt connected at the time of the diganostic test.
And yes im using a home network.
