Try:
- Powering off and then back on your router.
- iTunes for Windows: iTunes cannot contact the iPhone, iPad, or iPod software update server
- Change the DNS to either Google's or Open DNS servers
Public DNS — Google Developers
- For one user uninstalling/reinstalling iTunes resolved the problem
- Try on another computer/network
- Wait if it is an Apple problem

Sep 15, 2013 3:28 AM in response to BBDrewby Elitegate,Are you sure you have the 3rd generation? Look at the back of your iPod. If you have the model number A1288 you have a 2nd gen and this generation can't be updated past 4.2.1. A1318 indicates you have the 3rd gen and you can update till 5.1.1.
In that case try again later or with another computer.

Sep 15, 2013 12:02 PM in response to lllaassby BBDrew,I used my girlfriends Macbook Pro and I was able to update it no problem, for some reason it will not let me do it from my laptop and I use Windows 7 as my OS. So updating it from another computer solved the problem.
@ Elitegate - Yeah I am sure it was a 3rd Generation. I made sure to do a bit of research before coming here
