my iphone has been disabled and restoring it the factory settings is out of the question. how can I regain access to my content?

You cannot. If the iPhone has been disable due to incorrect
password attempts, that is a security feature and cannot be gotten
around.
my brother was using the phone at the time and he got into a fatal wreck. I know it wasn't synced to my computer. I've got get into this phone because there are things in there that tells us where he was and who he was with. that's why I stated that I absolutely could not restore the phone back to factory settings.
You must restore the iPhone by connecting it to iTunes on the
computer you usually sync with. Then you can put your content
back from your iCloud or other back up.
