I tried this and this is rally weird. The only way I could stop it was to double tap home button and close the app by swiping up on the preview of the app

Thanks for that. I just realised that that is the way you have to close down all of your open apps. The way I got out of the recording memo was to tap the top of the screen and then I could cancel the recording.
