I continually get apple id cannot be found

I have a 4s ios 7.0.2.

I am using a Macbook 4, 1 OSX 10.6.8

On the 4s i continually am prompted to agree to terms and conditions of an apple id that is deactivated.

this apple id is linked to Find my Iphone, I am prompted to turn off this,

I am unable to access this app (find my iphone) because i do not have the password to this deactivated account

Please help, since the upgrade to 7.0.2 its unbearable
